3. Your Rights as a Data Subject  
You have the right to request information about the processing of your personal data (e.g., the source of the data, the purpose of processing, and the methods of data processing). Under certain conditions, you are also entitled to object to the data processing in the future, restrict it, or request the deletion of your data. Furthermore, you may at any time object to the sending of advertising materials, market research, or commercial communications.  
In summary, you have the right to:

Overview of Our Data Processing Activities  
The following sections provide an overview of our data processing activities, which are structured as follows:  
- You visit our corporate website.  
- You enter into a search or marketing agreement with us, request a property brochure, or commission us to evaluate a property.  
- We search for a property for you together with another Engel & Völkers license partner (referral).  
- You apply for a job either proactively or in response to a job advertisement.  
- Storage and deletion of your data.

I. Collection and Processing of Personal Data When Visiting Our Corporate Website  
We process personal data only to the extent that you submit this data through the contact forms on our corporate website. The processing of personal data will only take place if you have given us your consent, or if processing is permitted by legal provisions. For certain services offered on our corporate website, we require a minimum amount of data. These mandatory fields are marked with an asterisk (*). Without these mandatory fields, we cannot provide the services indicated.

1. What data do we process from you (hereinafter "you" or "user")?  
When you use the website purely for informational purposes, meaning you do not register or submit any information to us, we only collect personal data that your browser transmits to our server. In addition to the purely informational or other use of our website, we offer various services that you can use if you are interested. For these services, you typically need to provide additional personal data, which we use to deliver the respective service and for which the aforementioned principles of data processing apply. We process personal data that we receive from potential customers and/or clients or their representatives/agents or employees during the business initiation phase and/or the course of our business relationship. We also process personal data when you visit our websites (including social media such as Facebook, Instagram, etc.). Specifically, we collect your personal data when you contact us, show interest in our products, register on our websites, contact us by email, phone, or through a contact form, or use our products and services in the context of an existing business relationship.  

Furthermore, we process, where necessary for the provision of our services, personal data that we have received from other companies in the Engel & Völkers Group or from other third parties in a lawful manner (e.g., for the execution of contracts, to fulfill agreements, or based on your consent). Additionally, we process, when necessary for our services, personal data that we have lawfully obtained from publicly accessible sources (e.g., debtor registers, commercial and association registers, press, media, internet) and are permitted to process.

e.g., first and last name, title, position/function, date of birth, private and business address, private and business phone number/mobile number, private and business email address, fax number, order and contract data (e.g., information about your product or contract interests, details of sought or offered properties) and property documents, land data, data from the fulfillment of our contractual obligations, copies of correspondence/communication contents, financial data, e.g., creditworthiness information, payment behavior, entries in credit agencies, payment arrears, income information, and other interests and wishes you share with us, e.g., information about participation in direct marketing measures. Additionally, other comparable data in relation to these categories may also be processed.

a) Google Analytics  
Engel & Völkers uses the Google Analytics web analytics service by Google Inc. ("Google") to analyze website usage. The information generated by cookies about website usage is typically transferred to and stored on a Google server in the USA. Engel & Völkers uses Google Analytics exclusively with the extension `ga('set', 'anonymizeIp', true)` to ensure that IP addresses are processed only in truncated form, which excludes direct identification of individuals. Google may share data with third parties where required by law or if third parties process data on behalf of Google. Google will not disclose the user's IP address in connection with other Google data. b)Universal Analytics  
Engel & Völkers also uses Universal Analytics features provided by Google. If a Google ID is available, the data controller will also record this data across all devices (e.g., if a user uses both a smartphone and a PC) to analyze user flow across devices. Google Remarketing and Retargeting  
We use Google Analytics advertising features, allowing users who have already visited the website and shown interest in certain offers to be re-targeted with ads on Google's partner networks. Advertising is displayed by using cookies that analyze user behavior during their visit to the website and send targeted product recommendations and advertisements based on user interests.

Facebook Remarketing and Retargeting  
We use remarketing technology for advertising on Facebook. The ads are served by cookies through the service provider AdRoll (AdRoll EMEA, Level 6; 1, Burlington Plaza, Burlington Road, Dublin 4, Ireland). This website contains links to major social media networks (e.g., Facebook and Twitter). 2. Purpose of Processing and Legal Basis  
We process your data for the following purposes:  
- Fulfillment of contact requests (legal basis is the performance of a contract and, in the case of sharing user data with other Engel & Völkers license partners (as defined below in section 3), your consent).  
- Potential fulfillment of requests for a market-appropriate valuation of the property described by the user and the associated sales interest (legal basis is the performance of a contract and, in the case of entering contact details by the user and forwarding them to a relevant Engel & Völkers license partner (as defined below in section 3) or to the company carrying out the valuation, your consent and, in the case of using the contact details for direct marketing, our legitimate interest in marketing our own services or your consent).  
- Contacting by phone (legal basis is the performance of a contract or, in the case of using the phone number for marketing purposes, your consent).  
- Sending email newsletters regarding our offers and own and third-party advertising, as legally permissible or based on consent (legal basis is either your consent or our legitimate interest in direct marketing, provided marketing is conducted in compliance with data protection and competition laws).

In Summary:  
The legal basis for the processing of personal data is Art. 6(1)(a) GDPR if the processing is based on consent, Art. 6(1)(b) GDPR if the processing is based on a (possibly pre-contractual) contractual relationship, and Art. 6(1)(f) GDPR if the processing is based on our legitimate interest. If the processing of personal data is necessary to fulfill a legal obligation to which we are subject, Art. 6(1)(c) GDPR serves as the legal basis.

When searching, selling, or renting a property, requesting a brochure, or conducting a property appraisal, the following personal data is regularly processed:
  - First name, last name, title, address, phone number, property request details (in case of a property search) or (in case of property marketing or appraisal) property details;
  - Email address, if you have agreed to receive marketing information, particularly regarding the offer or appraisal of properties, or wish to communicate via email;
  - If a property is being bought, sold, or rented, bank details, identity information, ID copy (in case of property sale), as well as land register, utility bills (e.g., electricity, gas), individual cost statements, declaration of division, homeowners' association protocols, purchase contracts (for property sales), or (in case of property rental) bank details, identity information, CV, salary certificate, credit report, landlord confirmation, and rental agreements.

2.Purpose of Processing and Legal Basis
We process this personal data for the following purposes:
  - Fulfillment of the contractual relationship or pre-contractual legal relationships – also by cooperating independent real estate advisors – including billing and credit checks (Legal basis: Art. 6(1)(b) GDPR and Art. 6(1)(f) GDPR; our legitimate interest in the transfer of data to independent real estate advisors arises from the freedom of choice in entering into contractual relationships with independent brokers or sub-brokers. Our legitimate interest in conducting credit checks arises from the need to protect against payment defaults);

If your inquiry (e.g., regarding a property appraisal request) involves offers from other license partners of the Engel & Völkers group, Engel & Völkers will transfer the personal data you provide in this case to the respective Engel & Völkers group company, after obtaining your prior consent.

Furthermore, in the course of executing a contractual relationship, we may share personal data with contract partners (property owners, landlords, prospective buyers) and supporting service providers such as notaries, lawyers, property managers, developers, as well as for credit checks or with regulatory authorities (e.g., for money laundering documentation). Please note that both we, as your primary contact, and the Engel & Völkers group license partner to whom your data is transferred, will process your personal data. Both we and the license partner are independently responsible for processing your data. Neither we nor the license partner have access to each other’s data, nor do we process your data jointly. If you wish to exercise your data subject rights, please check whether you want to address them to us or to the other Engel & Völkers group license partner, who also processes your data.

IV. You apply for a job with us, either initiatively or in response to a job advertisement

1.What Data Do We Process About You? 
When you apply via our website or through a job advertisement, we process your name, address, contact details, and application data. The provision of your address and contact details, as marked mandatory, is necessary to allow us to contact you about your application and assign it properly.

2.Purpose of Processing and Legal Basis  
We process your personal data for the following purposes:
  - Reviewing the application for employment within our company (Legal basis: Art. 6(1)(b) GDPR, possibly in conjunction with § 26 BDSG (for the application within Germany));
  - Defending against any potential legal claims arising from the application process against us, if necessary (Legal basis: our legitimate interest to fulfill the burden of proof in proceedings under the General Equal Treatment Act (AGG); Art. 6(1)(f) GDPR);

We need your personal data to fulfill the above-mentioned purposes. You are free to choose not to provide any personal data, but in this case, we cannot enable you to participate in the application process for available job offers.
