2. Your Rights as a Data Subject
You have a right to information about the processing of your personal data (for example, the origin of this data, the purpose of processing, the modalities of data processing). Furthermore, under certain conditions, you are entitled to object to data processing for the future, to restrict it, or to demand the deletion of the data. Finally, you can prevent the sending of advertising material or the conduct of market research or commercial communications at any time.

According to Art. 7 III of the EU (General Data Protection Regulation (hereinafter "GDPR") you can revoke your consent given to us at any time. This means that we may no longer continue the data processing based on this consent for the future.
Please note that your right to deletion is subject to restrictions. For example, we must or may not delete any data that we must continue to hold due to legal retention periods. Also, data that we need to assert, exercise or defend legal claims are excluded from your right to deletion.
If you have a complaint about the way we process your data, you have the opportunity to complain to a supervisory authority, in particular in the Member State of your place of residence, your workplace, or the place of the alleged infringement.
We reserve the right to disclose information about you if we are legally obliged to do so, and if the disclosure is demanded by legally acting authorities or law enforcement agencies from us. Legal basis: Art. 6 I sentence 1 lit. c GDPR (legal obligation).

I. Collection and Processing of Personal Data When Visiting Our Company Website on the Internet
We generally only process personal data to the extent that you transmit this to us via the contact forms located on our company website. The processing of personal data only takes place if you have given us your consent for this, or the processing is permitted by legal regulations. For certain services that we offer on our company website, we need a minimum amount of data. We have marked these mandatory details with a "star". Without the mandatory details, we cannot provide our services marked as such.
1. What data do we process from you (hereinafter "you" or also "user")
Within the scope of your use of our company website, we process personal data, namely:

2. Purpose of Processing and Legal Basis
We process your data for the following purposes:
● Fulfilment of contact requests (The legal basis is contract fulfilment and - in the case of the transfer of user data to other license partners of the Engel & Völkers Group (for the definition, please see below, item 3) your consent.)
● If applicable, fulfilment of the request for a valuation of the property described by the user in accordance with the market price and the sales interest transmitted with it (The legal basis is contract fulfilment and in the case of the entry of contact data by the user and their transfer to a materially or geographically competent license partner of the Engel & Völkers Group (for the definition, please see below, item 3) or to the company technically implementing the valuation your consent and in the case of using the contact data for direct marketing the legitimate interest in marketing our own services or your consent);
● Contact by phone by us (The legal basis is contract fulfilment or, in the case of using the telephone number for advertising purposes, your consent);
● Sending an email newsletter about our own offers and own and third-party advertising to the extent permitted by law or based on consent (The legal basis is either your consent or our legitimate interest in direct marketing, as long as the marketing is carried out in compliance with data protection and competition law requirements);
In summary:
The legal basis for processing personal data is Art. 6 I sentence 1 lit. a GDPR if the processing is based on consent, Art. 6 I sentence 1 lit. b GDPR if the basis of the processing is a (possibly pre-contractual) contractual relationship, and Art. 6 I sentence 1 lit. f GDPR if the basis is our legitimate interest. If the processing of personal data is necessary to fulfil a legal obligation to which we are subject, Art. 6 I sentence 1 lit. c GDPR serves as the legal basis.
If the legal basis is your consent, you are entitled to revoke your consent at any time without affecting the legality of the processing carried out on the basis of the consent until the revocation. If the legal basis is a legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you. In this respect, Art. 21 GDPR applies.
3. Transfer of Your Personal Data
We generally only pass on your personal data to third parties if this is necessary for contract fulfilment, if we or the third party have a legitimate interest in the transfer, if there is a legal obligation or if your consent is present. If data are transferred to third parties based on a legitimate interest, this is explained in these privacy policies.
If your contact request concerns offers from other companies in the Engel & Völkers Group, we transmit the personal data you entered in this case to the respective company from the Engel & Völkers Group after your prior consent or - if legally permissible - based on a so-called legitimate interest. Furthermore, we do not pass on your personal data.
When we speak of the "Engel & Völkers Group" within this privacy policy, we mean the companies belonging to the Engel & Völkers corporate group according to §§ 15ff. AktG and the contractually directly or indirectly affiliated (Master) license partners, to which we also belong. 4. Transfer of Data to Non-EEA Countries
In addition to the above paragraph "Transfer of Your Personal Data":
The recipients of personal data may be located outside the EEA/UK. When personal data is transferred to locations outside the EEA/UK, we will ensure, as required by law, that your data protection rights are adequately protected, either because the European Commission has decided that the country to which personal data are transferred provides an adequate level of protection (Art. 45 GDPR) or the transfer is subject to adequate safeguards (e.g., standard contractual clauses) of the European Union agreed with the recipient (Art. 46 GDPR), unless the GDPR provides for an exception (Art. 49 GDPR). In addition, we intend, where necessary, to agree on additional measures with the recipients to ensure an adequate level of data protection. Copies of the appropriate protective measures (to the extent that we rely on them) and a list of recipients outside the EEA/the United Kingdom can be requested. Please note that these copies may be blacked out to the extent necessary to protect trade secrets or other confidential information.
II. You Enter Into a Search or Marketing Contract with Us, Request an Exposé from Us or Commission Us with a Property Valuation
1. What Data Do We Process from You
In the search, sale or rental of real estate, exposé request, and property valuation, the following personal data is regularly processed from you:
● First name, last name, title, address, telephone number, details of the property request (in the case of property search) or (in the case of property marketing or property valuation) details of the property;
● Email address, if you have agreed to receive advertising information, in particular the offer or valuation of properties, or wish to communicate by email;
● and (if it comes to the purchase/sale or rental of real estate) bank details, identity information, copy of ID (when buying/selling real estate) and land register, electricity, oil and/or gas bills, general individual cost statements, declarations of division, WEG protocols (-resolutions, purchase contract (when selling a property) or (if it comes to renting a property) bank details, identity information, possibly CV, proof of salary, creditworthiness proof, landlord confirmation, tenancy agreement.
2. Purpose of Processing and Legal Basis
We process these personal data for the following purposes:
● Fulfilment of the contractual relationship or a pre-contractual legal relationship - also by cooperating independent real estate consultants - including invoicing and credit checks (The legal basis is Art. 6 I lit b. GDPR and Art. 6 I lit. f GDPR; our legitimate interest in connection with the transfer of data to independent real estate consultants results from the freedom of choice to also fulfil contractual relationships with independent brokers or sub-brokers. The legitimate interest in carrying out credit checks results from the legitimate interest in protecting against bad debts.);
● Fulfilment of a legal obligation, particularly in connection with the Money Laundering Act; (The legal basis is Art. 6 I lit. c GDPR);
● Advertising information about properties that we or other license partners of the Engel & Völkers Group market (The legal basis is Art. 6 I lit. f GDPR; the legitimate interest of us results from the processing of personal data for the purpose of direct advertising. The legal basis is also your consent according to Art. 6 I a. GDPR, if the advertising information is transmitted to you by email, fax or telephone.)
If the legal basis is your consent, you are entitled to revoke your consent at any time without affecting the legality of the processing carried out on the basis of the consent until the revocation. If the legal basis is a legitimate interest, you are also generally entitled, for reasons arising from your particular situation, to object at any time to the processing of personal data concerning you. Art. 21 GDPR applies in this respect.
3. Transfer of Data
If your request (e.g., during a valuation request) concerns offers from other license partners of the Engel & Völkers Group, Engel & Völkers transmits the personal data you entered in this case to the respective company from the Engel & Völkers Group after your prior consent.
Please also refer to our information on referral in section III.
Furthermore, we transmit personal data to contract partners (owners, landlords, search customers) and supporting service providers such as notaries, lawyers, property managers, developers, and in the context of credit reports or to supervisory authorities (such as for money laundering documentation) within the scope of contract execution. We may also pass on your data to third parties within the legally permissible framework. Third parties to whom we may pass on your personal data, regardless of our provision of services, include external consultants (e.g., lawyers and auditors), authorities within their jurisdiction to comply with statutory obligations and/or preserve our rights (e.g., tax office, police, public prosecutor's office, courts), potential buyers or acquirers of all or part of our assets and/or activities, and other third parties, to the extent that you instruct us to disclose data or give your consent.
In addition, we only pass on your personal data to employees (permanent employees such as employees and freelance real estate consultants) and third-party companies (e.g., IT service providers, hosting providers, etc.) to whom we have outsourced services with processing operations within the scope of order processing.
4. Transfer of Data to Non-EEA Countries
In addition to the preceding paragraph "Sharing Your Personal Data", the following applies:
Recipients of personal data may be located outside the EEA/UK. When personal data is transferred to locations outside the EEA/UK, we will, as required by law, ensure that your privacy rights are adequately protected, either because the European Commission has decided that the country to which personal data is being transferred ensures an adequate level of protection (Art. 45 GDPR) or the transfer is subject to adequate safeguards (e.g. standard contractual clauses) of the European Union, which have been agreed with the recipient (Art. 46 GDPR), unless the GDPR provides for an exception (Art. 49 GDPR). Furthermore, we intend to agree on additional measures with the recipients, as necessary, to ensure an adequate level of data protection. Copies of the adequate protection measures (to the extent we rely on them) and a list of recipients outside the EEA/the United Kingdom can be requested. Please note that these copies may be redacted to the extent necessary to protect trade secrets or other confidential information.
5. Storage and Deletion of Your Data
We store your personal data for the time necessary to achieve the purposes for which the data is collected and further processed, including any retention period required by applicable law (e.g. retention of accounting records).
In the context of application processes that end without employment / employment, your data will regularly be stored for six months for documentation purposes and then, as well as the documents sent to us, deleted or destroyed. With your consent to the processing of data for future application processes, we also keep this correspondingly longer.
