3. Your Rights as a Data Subject
You have the right to access information about the processing of your personal data (for example, its source, processing purpose, and processing methods). Under certain conditions, you also have the right to object to data processing, restrict processing, or request deletion of the data. You may also opt out of receiving promotional material, market research, or commercial communications at any time.

- Right to lodge a complaint with supervisory authorities
Additionally, you have the right to object at any time to the processing of your personal data for direct marketing purposes. If you object to processing for direct marketing, we will no longer process your personal data for such purposes.
Under Article 7 III of the EU General Data Protection Regulation ("GDPR"), you may revoke any consent you have given us at any time. This means we will no longer process data based on that consent moving forward.
Please note that the right to erasure may be limited. For instance, we are required or permitted by law to retain data for specific periods. Data needed to assert, exercise, or defend legal claims is also exempt from your right to deletion.
If you have a complaint regarding our processing of your data, you may lodge a complaint with a supervisory authority, particularly in the EU Member State of your residence, place of work, or where the alleged violation occurred.
We reserve the right to disclose information about you if legally required to do so and if requested by law enforcement authorities or governmental agencies. Legal basis: Article 6 I Sentence 1 lit. c GDPR (legal obligation).

I. Collection and Processing of Personal Data When Visiting Our Website
We generally only process personal data that you provide to us through the contact forms on our website. Data processing only occurs if you have given your consent or if processing is permitted by law. For certain services on our website, we require a minimum amount of information, which is marked with an asterisk (*). Without this required information, we cannot provide these designated services.
1. What data do we process about you (referred to as “you” or “user”)?
When you use our company website, we process personal data including:
- Email address, first name, last name, title, address, phone number, and property details. We refer to this information as "data" or "personal data" in connection with this privacy policy, which you provide when using our services (such as through contact inquiries, newsletters, or property valuations).

2. Purpose and Legal Basis of Processing
We process your data for the following purposes:
- To respond to contact requests (based on contract performance and, when sharing data with other Engel & Völkers Group partners, your consent);
- Property valuation requests and marketing interest (based on contract performance, or consent when data is shared with relevant partners or for direct marketing purposes);
- Contact by phone (based on contract performance or your consent for marketing purposes);
- Email newsletters, including our own offers and advertisements as permitted by law or by consent.
Summary of legal bases:
- The legal basis for data processing is Article 6 I (a) GDPR for consent, Article 6 I (b) GDPR for contractual relationships, and Article 6 I (f) GDPR for our legitimate interests. If necessary to fulfill legal obligations, Article 6 I (c) GDPR applies.
You may withdraw your consent at any time without affecting the lawfulness of processing up to the withdrawal. You may also object to processing based on our legitimate interest under Article 21 GDPR.
3. Disclosure of Your Personal Data
We share personal data with third parties only as needed for contract performance, if there is a legitimate interest, if required by law, or with your consent. Where we share data based on a legitimate interest, this is outlined in the policy.
If your contact inquiry relates to other Engel & Völkers companies, we share your data with the relevant Engel & Völkers Group company with your prior consent or, when legally permitted, on the basis of legitimate interest.

4. Data Transfer to Non-EEA Countries
Data recipients may be outside the EEA/UK. When personal data is transferred outside the EEA/UK, we ensure adequate protection as legally required, either because of an EU adequacy decision (Article 45 GDPR), EU Standard Contractual Clauses (Article 46 GDPR), or other exceptions (Article 49 GDPR). Additional measures may be implemented to ensure data protection. Copies of these safeguards and a list of recipients outside the EEA/UK can be requested.
II. Contracts or Requests for Real Estate Valuations
1. Data We Process About You
For real estate searches, sales, rentals, or valuations, we process:
- Name, address, phone, and property preferences;
- Email for marketing communications if consented to;
- For purchase/sale or rentals, identity and bank details, ID copies, land registry, utility statements, general expense records, WEG resolutions, sales or rental agreements.
2. Purpose and Legal Basis
We process this data for:
- Contract performance or pre-contractual obligations, including with independent real estate advisors (legal basis: Article 6 I (b) GDPR and 6 I (f) GDPR for legitimate interests in contract flexibility and creditworthiness checks);
- Legal obligations (e.g., anti-money laundering) under Article 6 I (c) GDPR;
- Marketing communications based on legitimate interest (Article 6 I (f) GDPR) or consent for emails, faxes, or phone (Article 6 I (a) GDPR).
You may withdraw your consent or object to processing based on legitimate interest at any time (Article 21 GDPR).
3. Data Disclosure
We may share data with Engel & Völkers Group partners for relevant offers, with service providers, and with contract parties such as property owners, lawyers, and other authorities when legally required.
4. Data Transfer to Non-EEA Countries
Data recipients may be outside the EEA/UK, with protection as outlined under the “Data Transfer to Non-EEA Countries” section. If inquiries involve Engel & Völkers Group partners outside the EU, data transfer occurs with your consent.
III. Joint Property Search with Other Partners
When we search for properties with another partner, data is shared only with your prior consent. Each partner is independently responsible for data processing.
IV. Job Applications
1. Data We Process About You
For applications, we process your name, address, contact, and application details.
2. Purpose and Legal Basis
We process data for evaluating employment applications (legal basis: Article 6 I (b) GDPR, § 26 BDSG) and defending against claims under the Equal Treatment Act (AGG, Article 6 I (f) GDPR). We may also process data based on consent for future job notifications.
3. Data Disclosure
Your data is disclosed to third parties only as necessary, for legitimate interests, or with consent.
If you applied through the Engel & Völkers Holding GmbH online portal, your documents are transferred to us. The Engel & Völkers Holding GmbH data processing policy is available on their website.
4. Data Transfer to Non-EEA Countries
Data recipients may be outside the EEA/UK, with protections in place as described above.
5. Data Retention and Deletion
We retain personal data only as necessary for the above purposes, including legal retention requirements. Application data for unsuccessful applications is stored for six months for documentation. With consent, we retain data for future applications.
