The real estate agent declares that - contrary to the customary business practice of the dual agent in the real estate industry - he is acting unilaterally only for the landlord. The brokerage fee plus VAT is due for payment at the legally stipulated rate only from the landlord's side upon conclusion of the tenancy agreement (see ancillary costs overview and information sheet). With the introduction of the so-called "Bestellerprinzip" in the brokerage of rental flats, the legislator assumes from 01. 07. 2023 that the real estate agent can generally only agree on a commission with the initial client. If the real estate agent is initially commissioned by the landlord or by someone authorised by the landlord to do so, he can only agree a commission with the landlord. At the same time, the real estate agent will usually refrain from acting as a double agent pursuant to § 5 MaklerG, but rather expressly declare pursuant to § 17 MaklerG that he will act unilaterally only for the landlord, not for the tenant.
